Welcome to Form Pilates FL ("Form Pilates," "the Studio," "we," "us," or "our"). These Terms ofService ("Terms") govern your use of our website (www.formpilatesfl.com), our booking platform,and your participation in classes, private sessions, workshops, and any other services offeredby the Studio (collectively, the "Services"). By creating an account, booking a class, or otherwiseusing our Services, you agree to these Terms. If you do not agree, please do not use ourServices.
1. Eligibility and Account Registration
1.1 You must be at least 18 years old to create an account and book Services on your own behalf.Clients between the ages of 14–17 may participate with the written consent of a parent or legalguardian, who must also complete registration and sign all required waivers on the minor'sbehalf.
1.2 You agree to provide accurate, current, and complete information when creating youraccount (including through our booking software, Mariana Tech) and to keep this informationup to date.
1.3 You are responsible for maintaining the confidentiality of your account login credentialsand for all activity that occurs under your account.
2. Health Disclaimer and Assumption of Risk
2.1 Pilates and reformer-based exercise involve physical activity and carry an inherent risk ofinjury, including but not limited to muscle strains, sprains, joint injuries, and other physicalharm.
2.2 By participating in any class or session, you represent that you are physically fit and haveno medical condition that would prevent your safe participation, or that you have consulted aphysician and received clearance to participate.
2.3 You are responsible for notifying your instructor, prior to class, of any injuries, pregnancy,surgeries, or medical conditions that could affect your participation. Instructors may modifyexercises but cannot guarantee the suitability of any exercise for your specific condition.
2.4 You voluntarily assume all risks associated with participation in our Services, known andunknown, and release Form Pilates FL, its owners, instructors, employees, and contractorsfrom any liability for injury, loss, or damage arising from your participation, except wherecaused by our gross negligence or willful misconduct.
2.5 A signed liability waiver and informed consent form is required before your first sessionand may be renewed periodically as required by the Studio.
3. Booking, Cancellations, and Late Arrivals
3.1 All classes and sessions must be booked in advance through our booking platform (MarianaTech) or as otherwise directed by the Studio.
3.2 Cancellation Policy: Cancellations made less than 12 hours before a scheduled class orsession may be charged a late cancellation fee and/or forfeit the credit or session used forbooking.
3.3 No-Shows: Failure to attend a booked class or session without cancelling will result inforfeiture of the class credit and may incur a no-show fee.
3.4 Late Arrivals: Out of respect for other clients, we may be unable to accommodate entry intoa class more than 5–10 minutes after its start time. Late arrivals may be asked to wait for thenext available class.
3.5 The Studio reserves the right to cancel or reschedule a class due to insufficient enrollment,instructor unavailability, or circumstances beyond our control. In such cases, affected clientswill be notified and credited accordingly.
4. Memberships, Packages, and Payments
4.1 Membership and class package terms (including pricing, expiration, auto-renewal, andfreeze/cancellation policies) will be presented at the time of purchase and are incorporated intothese Terms by reference.
4.2 Payments are processed securely through our booking and payment platform. By providingpayment information, you authorize the Studio to charge applicable fees, including recurringmembership dues, package purchases, and any late cancellation or no-show fees.
4.3 All sales are final unless otherwise stated at the time of purchase. Class packages andmemberships are non-transferable and non-refundable except as required by law or expresslypermitted by the Studio in writing.
4.4 Membership cancellations require advance written notice as specified in your membershipagreement. Dues owed prior to the effective cancellation date remain due and payable.
5. Studio Conduct and Etiquette
5.1 Clients are expected to treat instructors, staff, and fellow clients with courtesy and respect.The Studio reserves the right to refuse service or terminate membership for disruptive, unsafe,abusive, or inappropriate conduct, without refund.
5.2 Clients agree to follow all posted studio policies, including footwear (grip socks), attire,hygiene, and equipment-use guidelines communicated by staff.
5.3 Clients are responsible for the proper use of Balance Body equipment and other studioproperty. Clients may be held financially responsible for damage caused by misuse ornegligence.
6. Health and Safety
6.1 Please do not attend class if you are feeling unwell or showing symptoms of a contagiousillness. The Studio reserves the right to ask a client to leave a session if they appear too ill tosafely participate or pose a risk to others.
6.2 The Studio maintains equipment and facilities in accordance with manufacturer guidelinesand applicable health and safety regulations but makes no warranty that use of the facility orequipment is risk-free.
7. Intellectual Property
7.1 All content on our website and marketing materials, including but not limited to the FormPilates FL name, logo, class programming, and curriculum materials, is the property of FormPilates FL and may not be copied, reproduced, or distributed without prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Form Pilates FL and its owners, instructors, and staffshall not be liable for any indirect, incidental, special, or consequential damages arising out ofor related to your use of the Services. Our total liability for any claim arising from your use ofthe Services shall not exceed the amount you paid to the Studio in the twelve (12) monthspreceding the claim.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or legalrequirements. The updated Terms will be posted on this page with a revised effective date.Continued use of our Services after changes are posted constitutes acceptance of the updatedTerms.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sumter County, Florida.
